Product Warranty & Liability Disclaimer

This Product Warranty & Liability Disclaimer applies to products manufactured, assembled, distributed, or sold by Ascent Aid Limited (“Ascent Aid”).

For purposes of this Disclaimer, a Purchaser is the individual or entity that purchases an Ascent Aid product, and a User is any individual who uses an Ascent Aid product or any component contained within it.

By purchasing or using an Ascent Aid product, you acknowledge the following terms to the extent permitted by applicable law.

1. Intended Use

Ascent Aid products are designed to support medical preparedness in climbing, outdoor, and remote environments.

They are not substitutes for appropriate first aid or medical training, professional medical care, emergency medical services, or rescue services.

Users are responsible for understanding the proper use and limitations of the equipment they carry and should only use medical equipment within their level of training and competence.

2. User Responsibility

Climbing, mountaineering, and outdoor activities involve inherent risks, including serious injury and death.

Users are responsible for evaluating the risks associated with their activities, obtaining appropriate training, selecting appropriate equipment, and understanding the instructions and limitations applicable to individual products.

Users should inspect their Ascent Aid kit and its contents before use and replace components that are expired, damaged, opened, contaminated, missing, or otherwise compromised.

3. Third-Party Components

Ascent Aid kits may contain medical supplies, equipment, or other components manufactured by third parties.

Unless otherwise expressly stated, Ascent Aid does not manufacture these third-party components. Such products remain subject to their manufacturers' instructions, warnings, expiration dates, intended uses, and any applicable manufacturer warranties.

Users should review and follow the instructions and warnings provided by the manufacturer of each component.

4. Limited Product Warranty

Ascent Aid warrants that products assembled or manufactured by Ascent Aid will be free from material defects in workmanship at the time of delivery.

If an Ascent Aid-manufactured or assembled product arrives damaged or contains a confirmed manufacturing or assembly defect, contact Ascent Aid with proof of purchase and reasonable documentation of the issue.

When a valid warranty claim is confirmed, Ascent Aid may, at its option and subject to applicable law, repair the product, replace the affected product or component, or provide an appropriate refund.

This limited warranty does not cover ordinary wear and tear, misuse, improper storage, modification, accidents, contamination, use contrary to instructions, damage occurring after delivery, or expiration or deterioration of consumable medical supplies.

Any additional warranty period or procedures published by Ascent Aid at the time of purchase will also apply.

5. No Guarantee of Safety or Outcome

Ascent Aid does not guarantee the safety of climbing, mountaineering, outdoor, medical, rescue, or other activities undertaken while carrying or using an Ascent Aid product.

No first aid kit can account for every injury, illness, patient, environment, responder, or evacuation circumstance.

Possessing or using an Ascent Aid product does not guarantee successful treatment, rescue, evacuation, survival, or any particular medical outcome.

6. Life-Safety & Load-Bearing Use

Unless a particular product or component is expressly identified by Ascent Aid as tested, rated, and intended for a specific load-bearing or life-safety application, Ascent Aid products, pouches, attachment points, handles, straps, loops, and accessories must not be relied upon as climbing protection, anchors, fall-arrest equipment, belay equipment, rescue equipment, or other load-bearing life-safety equipment.

The ability to attach an Ascent Aid product to a climbing harness or other climbing equipment does not mean that the product or its attachment system is strength-rated for life-safety use.

7. Product Modification & Substitution

Modification of an Ascent Aid product may affect its performance and may void applicable warranties.

Ascent Aid may periodically modify product designs, packaging, materials, or kit contents and may substitute individual components with products of comparable purpose and quality when reasonably necessary due to availability, product improvement, or other manufacturing considerations.

8. Disclaimer of Warranties

Except for any express written warranty provided by Ascent Aid and to the fullest extent permitted by applicable law, Ascent Aid products are provided without additional express or implied warranties.

To the extent permitted by law, Ascent Aid disclaims implied warranties, including warranties of merchantability and fitness for a particular purpose.

Nothing in this Disclaimer excludes or limits warranties, rights, or remedies that cannot legally be excluded or limited.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Ascent Aid Limited will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the purchase, possession, use, misuse, or inability to use an Ascent Aid product or its contents.

To the fullest extent permitted by applicable law, Ascent Aid Limited's aggregate liability arising from or relating to a product will not exceed the amount paid to Ascent Aid for the product giving rise to the claim.

These limitations do not apply to liability that cannot legally be excluded or limited.

10. Third-Party Use

Purchasers should ensure that individuals to whom they provide an Ascent Aid product understand that medical equipment should be used according to applicable instructions, warnings, intended uses, and the user's level of training.

Providing an Ascent Aid product to another individual does not constitute medical training or establish that the recipient is qualified to use every component contained within the product.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Ascent Aid Limited and its officers, employees, agents, and representatives from claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful use, intentional misuse, unauthorized modification of an Ascent Aid product, or material violation of these terms.

12. Compliance With Laws

Users are responsible for complying with applicable federal, state, and local laws and regulations concerning the possession and use of medical equipment and other products.

13. Governing Law

This Disclaimer is governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

14. Severability

If any provision of this Disclaimer is determined to be invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.
